    Check out this new resource from Emond, now available in the PLA Library!



    Information provided on Emond's website:

    Evidence and Investigation, 3rd Edition is an up-to-date guide to the technical and practical aspects of effectively managing evidence from the crime scene to the courtroom. Our authors draw on their decades of experience in criminal investigations, forensic science, and digital evidence to provide a comprehensive overview of the different types of evidence, crime scene management, and the latest research in forensics.  

    Part I introduces readers to Canadian criminal evidence law, covering the different classes of evidence and the legal considerations governing admissibility, as well as the roles and responsibilities of individuals involved in crime scene investigation and management. Part II provides a detailed examination of forensic science, including specific types of evidence: biological, chemical, and digital while emphasizing the importance of Charter -compliancy, continuity, and accuracy during evidence collection. Part III addresses the role of evidence in the courtroom, focusing on the Crown’s legal duties, law enforcement testimony, as well as protocols for avoiding factors that often contribute to errors during an investigation.

    Canadian businesses, organizations and governments are not immune from the pressures of domestic and international bribery and corruption of public officials. As Canadian businesses continue to expand their corporate presence overseas, governmental statutes and regulations have established more anti-corruption rules against the bribery of foreign public officials by Canadian companies and their directors and officers. Until Canadian Anti-Corruption Law and Compliance, there was no book focused exclusively on anti-corruption laws in Canada. This unique book has been edited and expanded to deal with domestic corruption of public officials, given the rise in media, social, and legal awareness of increased domestic bribery and corruption activity in Canada.

    This book will help corporate compliance officers, in-house counsel, procurement officials, lawyers, law enforcement officials, government policy makers, and in-house counsel understand the scope and gravity of these laws.     In Detention, Arrest, and the Right to Counsel, Justice Davin Michael Garg (Ontario Court of Justice) and defence counsel Anil Kapoor provide a practical examination of early “street level” interactions between law enforcement and members of the public through the lens of sections 9 and 10 in the Canadian Charter of Rights and Freedoms.  

    National in scope, this resource focuses on three major areas: detention, arrest and the right to counsel. The first major area covers the power to detain a person, addressing law enforcement’s statutory and common law powers, including investigative detention and traffic stops. This area also addresses the issue of racial profiling. The second area covers the power to arrest, including the mechanism of an arrest, reasonable grounds, arrest with and without warrant, and more. Unlike other texts in this area, this handbook includes a third area with comprehensive coverage of the right to counsel, discussing law enforcement’s informational and implementational obligations under sections 10(a) and 10(b).
